New Report: How Manhattan DA Alvin Bragg and Judge Merchan Violated the Constitutional and Legal Rights of President Donald J. Trump

WASHINGTON, D.C. – Today, the House Judiciary Committee and its Select Subcommittee on the Weaponization of the Federal Government released an interim staff report titled, “Lawfare: How the Manhattan District Attorney’s Office and a New York State Judge Violated the Constitutional and Legal Rights of President Donald J. Trump.” The state or local prosecution of a current or former president by a popularly elected district attorney raises substantial federal interests and raises serious concerns about conflict between state and federal entities.

The report explains the several ways in which New York County District Attorney (DANY) Alvin Bragg’s prosecution of President Trump suffers from severe legal and procedural defects, including:

Bragg’s unconstitutional and unprecedented Russian-nesting-doll theory of criminal liability, in which the jury never had to reach unanimity as to each element of the criminal offenses; and
Bragg’s usurpation of the federal government’s exclusive authority to prosecute alleged violations of federal campaign finance laws and the Biden-Harris Administration’s refusal to intercede to protect federal interests.

The report also details Judge Merchan’s egregious legal rulings before and during the trial that all cut against President Trump’s rights, including:

Judge Merchan’s failure to recuse himself for manifest political bias against President Trump;
The unconstitutional gag order he imposed on President Trump during the trial;
Judge Merchan’s admission of plainly inadmissible, irrelevant, and unfairly prejudicial testimony against President Trump; and
Judge Merchan’s refusal to permit former Federal Election Commission Chairman Bradley Smith to testify as to the meaning and complexities of the Federal Election Campaign Act.

Every person admitted to practice law in New York, including elected district attorneys and appointed judges, must take a “constitutional oath of office,” swearing or affirming to “support the constitution of the United States, and the constitution of the State of New York.” By taking that oath, District Attorney Alvin Bragg and Judge Juan Merchan were legally “bound to a constitutional course of conduct.” In their politicized efforts to indict and convict President Trump, they failed their oaths of office.Given that President Trump’s indictment was conceived in legal and constitutional error and the trial exacerbated and compounded those errors, an honest review of the facts and the law will likely lead appellate courts to vacate the conviction and dismiss the indictment with prejudice. This will go a long way in restoring the American people’s trust and confidence in our justice system, although more work is ahead. In the meantime, the Committee and Select Subcommittee will continue our oversight of lawfare and its effect on the rule of law in the United States. source

Gunman Killed at Trump Rally Shooting, Ex-President Wounded in Ear

Shooter is killed by Secret Service, and Donald Trump says he felt bullet rip through his ear; the Pennsylvania rally shooting is being investigated as assassination attempt

Former President Donald Trump said on social media he was “shot with a bullet that pierced the upper part of my right ear” when gunfire erupted at a campaign rally in Butler, Pa., Saturday. The Secret Service shot and killed a suspected gunman.
Federal authorities are investigating the shooting as an assassination attempt.
One spectator was killed and two others were critically injured after “multiple shots” were fired, the Secret Service said on social media.
Details on the suspected shooter weren’t immediately available.
The gunman used a rifle and fired from an elevated position outside of the rally, the Secret Service added.
President Biden spoke to the former president and is returning to Washington from Rehoboth Beach, Del.
Earlier, Biden declared there is “no place in America for this sort of violence. It’s sick.”
Messages of concern and support for Trump poured in immediately from top Democrats and top Republicans as well as former presidents—all decrying political violence.
Some Republicans blamed the shooting on Biden’s rhetoric; but Trump said motive is not clear.

Former President Donald Trump was shot in the ear Saturday evening while speaking onstage at his rally in Butler, Pennsylvania, in an incident that’s being investigated as an assassination attempt from a shooter on a roof near the rally site.

Trump fell to the ground after the first pop of shots rang out at approximately 6:15 p.m. ET. Secret Service agents rushed the stage to surround Trump as screams were heard from onlookers. After several moments, Trump was brought to his feet by the agents, and he appeared to be calling out to the crowd and could be seen pumping his fist as he was whisked away into a vehicle offstage.

One of the rally attendees was killed, and and two rally-goers were critically injured, according to the Secret Service.

The shocking episode that threatened Trump’s life raises grave questions about security and how the former president was shot at, with lawmakers already calling for an investigation into the Secret Service’s handling of Saturday’s rally. The shooting comes right before Trump is set to accept the 2024 presidential nomination at the Republican National Convention this coming week.

A law enforcement source and a police officer at the scene told us that the shooter was positioned on a building rooftop just outside the venue where Trump was holding his rally, located to the right of the event stage. There was a heavy law enforcement presence around the building.

Video posted to social media showed the suspected Trump shooter lying down on the roof of a building, appearing motionless. Multiple law enforcement sources have referred to this individual as a sniper, although additional details are not yet clear.

The Secret Service said the shooter fired “multiple shots toward the stage from an elevated position outside of the rally venue.” The shooter was killed by Secret Service agents, the agency said in a statement.

Trump posted on Truth Social later Saturday evening, describing the shooting and thanking the Secret Service and law enforcement for their response.

“I was shot with a bullet that pierced the upper part of my right ear. I knew immediately that something was wrong in that I heard a whizzing sound, shots, and immediately felt the bullet ripping through the skin. Much bleeding took place, so I realized then what was happening. GOD BLESS AMERICA!” Trump wrote.

The shooting is being investigated as a possible assassination attempt, according to law enforcement officials.

Rep. Dan Meuser, a Pennsylvania Republican, was sitting in the front row of Trump’s rally with Pennsylvania GOP Senate candidate Dave McCormick and Rep. Mike Kelly. The congressman told the spectator, who was fatally shot and killed, was “no more than 20 feet behind” them.

“Everybody started, certainly, screaming, asking for a medic, and honestly, it was a bloody scene,” Meuser said.

Butler County District Attorney Richard Goldinger said he was told by his chief detective that the shooter was on a building adjacent to the property.

“It would have required a rifle,” he said. “It was several hundred yards.”

Biden: ‘It’s sick’

President Joe Biden was briefed in Rehoboth Beach, Delaware, on the shooting. Secret Service Director Kimberly Cheatle, Homeland Security Secretary Alejandro Mayorkas and Homeland Security adviser Liz Sherwood-Randall were part of the team briefing the president.

Biden spoke from Rehoboth Beach Saturday evening, saying he had been “thoroughly briefed” on the incident and was trying to reach out to Trump to speak with him.

“There’s no place in America for this kind of violence – it’s sick, it’s sick,” Biden said. “It’s one of the reasons why we have to unite this country. We cannot allow for this to be happening. We cannot be like this. We cannot condone this.”

Rico Elmore, a former Pennsylvania legislative candidate who was a speaker at Saturday’s rally, had blood all over his white shirt and was walking away from the rally stage as he spoke to our reporters on the ground and described jumping over the barrier and putting his hand on the head of an attendee who was shot and bleeding.

“All we know is shots were fired and then I jumped over the barrier and put my hand on the guy’s head that was profusely bleeding,” Elmore said. He said he didn’t know the attendee and he was “just a stranger.”

Elmore was visibly shaken up but said he was not harmed. He said he only saw one attendee hit and did not see what happened to Trump.

Sounded like ‘firecrackers’

Lawmakers on both sides of the aisle quickly weighed after the shooting Saturday expressing their horror, condemning the political violence. Leaders around the world sent their well wishes to the former president.

“I have been briefed by law enforcement and am continuing to monitor the developments. This horrific act of political violence at a peaceful campaign rally has no place in this country and should be unanimously and forcefully condemned,” House Speaker Mike Johnson said in a statement.

“I am horrified by what happened at the Trump rally in Pennsylvania and relieved that former President Trump is safe. Political violence has no place in our country,” said Senate Majority Leader Chuck Schumer.

Former Trump campaign adviser David Urban had spoken with McCormick, the Republican nominee for Senate from Pennsylvania, who was sitting in the front row of the rally. Trump told McCormick to “come up here onstage,” Urban said, at which point he heard a few “pops” that sounded like “firecrackers.”

McCormick dropped to the ground at that point, and when he got up, he said that Secret Service agents were “around everybody and they were scattering,” according to Urban.

McCormick wrote on X that he and his wife, former Trump administration official Dina Powell, “are praying for President Trump and all who were injured today in Butler PA.” source

The Biden administration authorized the use of deadly force during the FBI’s raid on former President Trump’s Mar-a-Lago estate in Florida in August 2022 as part of its investigation into classified records, court documents revealed.

“The FBI followed standard protocol in this search as we do for all search warrants, which includes a standard policy statement limiting the use of deadly force. No one ordered additional steps to be taken and there was no departure from the norm in this matter,” the FBI told Fox News in a statement Tuesday.

An “Operations Order” produced in discovery as part of Special Counsel Jack Smith’s investigation into Trump’s alleged improper retention of classified records revealed that the “FBI believed its objective for the Mar-a-Lago raid was to seize ‘classified information, NDI, and US Government records,’” as described in the search warrant.

The order, according to a court filing, contained a “Policy Statement” regarding “Use of Deadly Force,” which stated, for example, “Law Enforcement officers of the Department of Justice may use deadly force when necessary.”\

According to the filing, the DOJ and FBI agents “planned to bring ‘Standard Issue Weapons,’ ‘Ammo,’ ‘Handcuffs,’ and ‘medium and large sized bolt cutters,’ but they were instructed to wear ‘unmarked polo or collared shirts’ and to keep ‘law enforcement equipment concealed.”

Trump, who spent another day in a New York City courtroom for his unprecedented criminal trial stemming from Manhattan District Attorney Alvin Bragg’s investigation into Trump allegedly falsifying business records, reacted to the revelations Tuesday afternoon.

Trump was charged out of Smith’s investigation into his retention of classified materials. Trump pleaded not guilty to all 37 felony charges from Smith’s probe, including willful retention of national defense information, conspiracy to obstruct justice, and false statements.

Trump was also charged with an additional three counts as part of a superseding indictment out of the investigation: a count of willful retention of national defense information and two obstruction counts.

Trump pleaded not guilty.

The federal judge presiding over the case, Judge Aileen Cannon of the U.S. District Court for the Southern District of Florida, postponed the trial stemming from Smith’s case indefinitely. The trial was set to begin May 20. source

Trump campaign releases ‘Never Surrender’ merchandise with former president’s mugshot

Hours after former President Donald Trump’s booking photo at the Fulton County Jail in Atlanta, Georgia, was released, the official store of his 2024 campaign added eight new items featuring the historic mugshot.

Ranging from $12 to $34, the items available include a bumper sticker, a coffee mug, koozies in black and white, and short-sleeve and long-sleeve shirts in black and white. All eight items include Trump’s mugshot, the “NEVER SURRENDER!” tagline and the Trump 2024 Make America Great Again logo.

He added: “It is not a comfortable feeling—especially when you’ve done nothing wrong.”

“This is all about election interference,” Trump said. “It all comes through Washington and the DOJ and Crooked Joe Biden—nothing like this has ever happened in our country before.”

Trump tweets for the first time since getting banned from Twitter

Former President Donald Trump posted to X (formerly Twitter) for the first time since he was banned from the platform in January 2020.

Trump tweeted an image of his mug shot, with captions “ELECTION INTERFERENCE” and “NEVER SURRENDER!”

Twitter put a “lifetime ban” on Trump’s account after the Jan. 6, 2021 riot at the Capitol. Elon Musk reinstated the former president’s account after he purchased the company in 2022, but Trump had not posted until Thursday.

Trump’s mug shot was taken at the Fulton County Jail in Atlanta, Georgia earlier Thursday when he was booked and released on charges related to his alleged efforts to overturn the 2020 election.

Twitter was Trump’s main communication platform throughout his 2016 presidential campaign, and he famously used the social media site during his presidency to snipe at rivals, discuss White House policy and praise supporters.

He told Fox News last year that despite his account being restored, he would continue to post on his own social media platform, Truth Social.

The 13 counts against Trump include: violating the Georgia RICO Act – the Racketeer Influenced And Corrupt Organizations Act; Solicitation of Violation of Oath by a Public Officer; Conspiracy to Commit Impersonating a Public Officer; Conspiracy to Commit Forgery in the First Degree; Conspiracy to Commit False Statements and Writings; Conspiracy to Commit Filing False Documents; Conspiracy to Commit Forgery in the First Degree; Filing False Documents; and Solicitation of Violation of Oath by a Public Officer.

Trump Force One departs Atlanta after Trump jail release

“This should never happen. If you challenge an election, you should be able to challenge an election,” Trump said.

Trump added that the country would have “very dishonest elections” without the right to challenge them, before going on to tout the level of support he said he’s been receiving.

“This is their way of campaigning. This is one instance, there are three other instances. It’s election interference,” he added, appearing to reference the Biden administration.

According to the record, his height is listed as 6’3.

Trump’s weight was listed as 239 pounds in his 2018 physical examination by then-White House physician Ronny Jackson, who now serves in the U.S. House of Representatives.

Rudy Giuliani’s Fulton County mughshot was met with glee by Democrats on social media. “Should we blast it everywhere?” one New York-based anti-Trump activist asked.

Giuliani, the former mayor of New York City, is one of 18 named co-conspirators in the ex-president’s fourth criminal indictment in under six months. Trump and the other defendants are accused of conspiring to overturn the results of the 2020 election in Georgia.

Giuliani’s booking photo made waves on social media, including with Trump’s Democrat critics.

“Smile Rudy your[sp] on camera,” Omar quipped on her Instagram story.

Who is Harrison Floyd? Former Black Voices for Trump director being held in Georgia jail

Harrison Floyd, the former Black Voice for Trump executive director, is being held in the Fulton County Jail in Atlanta, Georgia after turning himself in on Thursday in connection to District Attorney Fani Willis’ investigation into alleged efforts to overturn the 2020 election.

Floyd was allegedly involved in efforts to pressure poll workers into promoting fraud allegations in favor of former President Donald Trump following the election, according to the Atlanta Journal-Constitution.

According to court records, Floyd is a former U.S. Marine who was active with the pro-Trump group. He was arrested in Maryland three months ago for allegedly assaulting FBI agents serving him a subpoena to appear before a grand jury for an unknown reason.

Fulton County jail records show Floyd is being held with no bond. He is the only person indicted in connection with Willis’ investigation that did not negotiate bond terms prior to his surrender.

McConnell plows through farm bill speech with no mention of Trump hours before expected arrest

Sen. Mitch McConnell, R-Ky., gave a policy-heavy speech at a Kentucky Farm Bureau event hours before former President Donald Trump is expected to surrender at a Georgia jailhouse.

Unsurprisingly, Trump’s name and impending arrest did not come up in McConnell’s remarks.

A Georgia judge approved a rapid trial date for one of former President Donald Trump’s co-defendants in the Fulton County case related to the 2020 election.

Judge Scott McAfee ordered a trial date for Oct. 23 for Kenneth Chesebro, who filed a motion for a speedy trial. That leaves just two months for arraignment, evidence discovery, motions and pretrial conferences.

The Oct. 23 trial date, however, only applies to Chesebro. “At this time, these deadlines do not apply to any co-defendant,” Judge McAfee’s order states.

Chesebro faces seven charges, including a violation of the Georgia’s RICO Act—the Racketeer Influenced And Corrupt Organizations Act.

The Department of Justice (DOJ) is actively investigating the jail where former President Donald Trump may be booked after his arrest in Fulton County.

DOJ opened an investigation into conditions inside the Fulton County Jail last month after an “extensive” review of publicly-available information. That review included a report about LaShawn Thompson, an inmate who died in September 2022 after he was allegedly eaten alive by bugs in his cell, FOX 5 Atlanta reported.

An autopsy said Thompson died of complications due to severe neglect and major contributing causes as untreated schizophrenia, dehydration, malnourishment and severe body insect infestation. His death was ruled a homicide.

“These autopsy findings confirm that Lashawn was killed by the extreme neglect of the Fulton County Jail and its staff,” Ben Crump, a civil rights attorney representing Thompson’s family in a lawsuit against the jail, said in a May 22 statement. “He was dehydrated, malnourished, and his body was infested inside and out with insects — it is truly one of the most horrific cases we have seen.”

The state of the jail could complicate negotiations between the Fulton County Sheriff’s Department and the Secret Service over how Trump will be booked.

According to the department’s website, individuals who have been arrested are first taken to the Main Jail at 901 Rice Street NW, Atlanta, for booking. Fulton County Sheriff Pat Labat said earlier this month he expects Trump to be booked like any other criminal suspect, including fingerprinting and photographing.

Trump has an August 25 deadline to turn himself in to Fulton County authorities.

Trump ally Harrison Floyd remains in Georgia jail after not negotiating bond terms before surrender

Harrison Floyd, the former executive director of Black Voices for Trump, is currently sitting in the Fulton County Jail in Atlanta, Georgia after turning himself in on charges in connection to District Attorney Fani Willis’ investigation into alleged efforts to overturn the 2020 election.

Floyd is the only defendant who did not negotiate bond terms before surrendering. All other 18 defendants, including former President Donald Trump, have now reached bond terms. 11 have surrendered — including Floyd — the other 10 have been released.

Floyd was allegedly involved in efforts to pressure poll workers into promoting fraud allegations, according to the Atlanta Journal-Constitution.

Republicans on the House Judiciary Committee have accused Fulton County District Attorney Fani Willis of filing “politically motivated” charges against former President Donald Trump.

In a letter sent to Willis Thursday, Chairman Jim Jordan, R-Ohio, raised concerns about the timing of Willis’ actions and demanded that her office turn over any documents and communications with the Biden administration.

“Your indictment and prosecution implicate substantial federal interests, and the circumstances surrounding your actions raise serious concerns about whether they are politically motivated,” Jordan wrote.

“[I]t is noteworthy that just four days before this indictment, you launched a new campaign fundraising website that highlighted your investigation into President Trump,” the letter continued. “Additionally, the forewoman of the special grand jury you convened to investigate President Trump earlier this year bragged during an unusual media tour about her excitement at the prospect of subpoenaing President Trump.”

“The timing of this prosecution reinforces concerns about your motivation,” the letter states. “In February 2021, news outlets reported that you directed your office to open an investigation into President Trump … Yet, you did not bring charges until two-and-a-half years later, at a time when the campaign for the Republican nomination is in full swing.”

Georgia’s secretary of state reportedly is to be subpoenaed to testify during a hearing to determine if former White House Chief of Staff Mark Meadows’ election interference case will be transferred to federal court next week.

Meadows, meanwhile, had an emergency motion seeking to prevent his “imminent arrest” in Fulton County denied Wednesday, a day before former President Donald Trump was set to turn himself in. Meadows had sought to stall his arrest pending the outcome of an evidentiary hearing over the possibility of his RICO charges be moved from state to federal court, FOX 5 Atlanta reported.

A judge, however, ruled the state should continue for now unless the feds notify the court that they’re taking over jurisdiction. Fulton County District Attorney Fani Willis set a deadline for noon Thursday for Meadows, Trump and allies to turn themselves in.

“While Meadows’s imminent arrest may present an actual injury, there are strong countervailing reasons to not enjoin the state criminal proceedings,” the judge’s decision Wednesday said. “Thus, the Court determines that, the clear statutory language for removing a criminal prosecution, does not support an injunction or temporary stay prohibiting District Attorney Willis’s enforcement or execution of the arrest warrant against Meadows.”

A mugshot of Rudy Giuliani was released Wednesday after the former New York City mayor turned himself in at an Atlanta jail on charges connected to alleged efforts to overturn the results of the 2020 presidential election in Georgia.

Giuliani, 79, was indicted last week along with former President Donald Trump and 17 others. Fulton County District Attorney Fani Willis said they participated in a wide-ranging conspiracy to subvert the will of the voters after the Republican president lost to Democrat Joe Biden in November 2020.

First two Trump co-defendants were booked in Fulton County Jail on Tuesday

The first two of former President Donald Trump’s co-defendants in the Georgia election meddling case turned themselves in to authorities Tuesday morning.

Scott Hall, an Atlanta-based bail bondsman, and John Eastman, a former Trump attorney, were each booked at the Fulton County Jail, records show. Hall has been assigned a $10,000 bond for seven charges. Eastman accepted a $100,000 bond.

The two men were indicted last week alongside Trump and 16 others, who are accused by Fulton County District Attorney Fani Willis of scheming to subvert the will of Georgia voters in a desperate bid to keep Joe Biden out of the White House. It was the fourth criminal case brought against the Republican former president.

Eastman, a former dean of Chapman University law school in Southern California, faces charges related to his advice to Trump on how the former president could overturn the 2020 election.

Hall is accused of conspiring to unlawfully access voter data and ballot counting machines at the Coffee County Election office on Jan. 7, 2021. His seven charges include one count of violation of the Georgia RICO Act, two counts of conspiracy to commit election fraud, one count of conspiracy to defraud Georgia, and three felony counts related to his alleged actions in Coffee County.

Eastman said in a statement provided by his lawyers that he was surrendering Tuesday “to an indictment that should never have been brought.” He lambasted the indictment for targeting “attorneys for their zealous advocacy on behalf of their clients” and said each of the 19 defendants was entitled to rely on the advice of lawyers and past legal precedent to challenge the election results.

Federal judge delivers blow to Trump co-defendants in Georgia election case

A federal district court judge turned down requests from two co-defendants in the Georgia racketeering case involving former President Trump to transfer jurisdiction of their cases to federal court.

Judge Steve Jones of the Northern District of Georgia issued two simultaneous orders Wednesday, denying the requests from former Trump White House chief of staff Mark Meadows and former Department of Justice civil division chief Jeff Clark. Meadows and Clark requested in their motions that their cases are transferred and for the court to allow them to avoid arrest in the case.

“Nothing Mr. Meadows is alleged in the indictment to have done is criminal per se: arranging Oval Office meetings, contacting state officials on the President’s behalf, visiting a state government building, and setting up a phone call for the President,” counsel for Meadows wrote in a court motion filed Aug. 15. “One would expect a Chief of Staff to the President of the United States to do these sorts of things.”

“Mr. Clark asks the Court either to grant a stay (or a temporary restraining order) against Fulton County … or to grant an administrative stay as we describe below,” counsel for Clark added in a motion on Aug. 21. “If the Court grants a stay … Mr. Clark would not need to be put the choice of making rushed travel arrangements to fly into Atlanta or instead risking being labeled a fugitive.”

Both Meadows and Clark argued in their motions that, because they were federal officials at the time of the alleged crimes, their cases should be handled by the federal court system.

However, Jones denied the requests, stating in the Meadows order that “the clear statutory language for removing a criminal prosecution, does not support an injunction or temporary stay prohibiting [Georgia’s] enforcement or execution of the arrest warrant against Meadows.”

Trump, in an exclusive interview with Fox News Digital Thursday night, said officials in Georgia “insisted” on a mugshot.

“It is election interference,” he said. “We did nothing wrong at all. And we have every right every single right to challenge an election that we think is dishonest that we think is very dishonest.”

Willis, on Thursday, asked the Fulton County court to set a trial date for Trump and all 18 co-defendants in the case for October 23. The move was in response to a motion for a speedy trial from defendant Kenneth Chesebro.

The judge approved the October 23 trial date, but only for Chesebro, as he was the only defendant to request a speedy trial.

Meanwhile, Trump retained Steven Sadow, an Atlanta-based white collar defense attorney, to represent him in the Fulton County case. Sadow will replace Drew Findling, who had been representing him in the matter. Findling is no longer representing Trump, a source familiar told Fox News Digital.

The indictment out of Georgia was the fourth for Trump, who is the first former president in United States history to face criminal charges.

Trump was first charged in March out of Manhattan District Attorney Alvin Bragg’s years-long investigation related to hush-money payments made during the 2016 presidential campaign.

Bragg alleged that Trump “repeatedly and fraudulently falsified New York business records to conceal criminal conduct that hid damaging information from the voting public during the 2016 presidential election.”

Those charges from Bragg came amid Special Counsel Jack Smith’s investigation into Trump’s alleged improper retention of classified records from his presidency at his Mar-a-Lago home in Palm Beach, Fla.

Trump pleaded not guilty to all 37 felony charges out of that probe. The charges include willful retention of national defense information, conspiracy to obstruct justice and false statements.

Last month, on July 27, Trump was charged with an additional three counts as part of a superseding indictment out of Smith’s investigation — an additional count of willful retention of national defense information and two additional obstruction counts.

Smith was also investigating whether Trump was involved in the Capitol riot on Jan. 6, 2021, and any alleged interference in the 2020 election result.

On Aug. 1, Trump was indicted on four federal charges out of Smith’s Jan. 6 probe.

Former President Trump made clear Tuesday evening he won’t drop out of the 2024 presidential race if convicted of charges related to a 2016 illegal hush money payment to adult film star Stormy Daniels.

Driving the news: Fox News host Tucker Carlson asked Trump if there’s anything legal that could make the 2024 Republican presidential candidate drop out of the race. “No, I’d never drop out,” Trump said.

A Manhattan grand jury has voted to indict Donald Trump on charges involving payments made during the 2016 presidential campaign to silence claims of an extramarital sexual encounter, his lawyers said Thursday, producing the first criminal case against a former U.S. president and a jolt to Trump’s bid to retake the White House.

Trump, who has denied any wrongdoing and has repeatedly attacked the investigation, called the indictment “political persecution” and predicted it would damage Democrats in 2024.

The indictment is an extraordinary development after years of investigations into his business, political and personal dealings. It is likely to galvanize critics who say Trump lied and cheated his way to the top and embolden supporters who feel the Republican is being unfairly targeted by a Democratic prosecutor.

In a statement, his lawyers, Susan Necheles and Joseph Tacopina, said: “He did not commit any crime. We will vigorously fight this political prosecution in court.”

Yes, Trump can still run for president

Nothing in the U.S. Constitution prohibits candidates with criminal records from holding office.

The only qualifications needed to run is to be at least 35 years old and be a natural born citizen who has lived in the country for at least 14 years.

However, according to Section 3 of the 14th Amendment, a person who has engaged in an insurrection or rebellion against the United States, cannot hold office unless overcome with a two-thirds vote from Congress.

Minutes after the indictment was announced Thursday, Trump released a lengthy statement calling it the next step in a campaign from the left “to destroy the Make America Great Again movement.”

“The Democrats have lied, cheated and stolen in their obsession with trying to ‘Get Trump,’ but now they’ve done the unthinkable – indicting a completely innocent person in an act of blatant Election Interference,” Trump’s statement said.

Trump accused Manhattan District Attorney Alvin Bragg of “doing Joe Biden’s dirty work, ignoring the murders and burglaries and assaults he should be focused on.”

Alina Habba, an attorney for Trump, said the former president is a victim “of a corrupt and distorted version of the American justice system and history. He will be vindicated.”

An indictment wouldn’t stop Trump from continuing his campaign. There is no prohibition against running while facing criminal charges — or even following conviction. Indeed, convicted felons have run for president before, including from behind bars.

How will this impact his chances of winning in 2024?

Trump faces other potential legal perils as he seeks to reassert control of the Republican Party and stave off a slew of one-time allies who are seeking or are likely to oppose him for the presidential nomination.

The district attorney in Atlanta has for two years been investigating efforts by Trump and his allies to meddle in Georgia’s 2020 vote count. And a U.S. Justice Department special counsel is investigating Trump’s storage of classified documents at his Mar-a-Lago home in Florida and his efforts to reverse his election loss.

Politically, Trump allies believe the case actually will benefit the former president in the short term by energizing his base in a competitive Republican primary, and would provide another boost later on if it ultimately fails to yield a conviction.

“The prosecutor in New York has done more to help Donald Trump get elected,” says Sen. Lindsey Graham, R-S.C., echoing other GOP officials, who have also argued the probe will likely help Trump in the short term, even if it could prove damaging in a general election.

“It boggles the mind to think that we have an ex-president on the eve of being indicted still the frontrunner for the Republican Party in 2024,” said presidential historian Douglas Brinkley weeks before Trump was indicted. “You would have thought (potentially) being arrested would have been a disqualifying factor in presidential politics. But Trump constantly surprises people by his devious and inappropriate behavior that he transcends by turning it into being a victim of a witch hunt.” source

Donald Trump has become the first former president to face criminal charges in U.S. history, indicted in New York for the role he played in paying hush money to a porn star.

The historic indictment raises many questions as the country barrels toward the 2024 presidential election, in which Trump is the leading candidate for the Republican nomination.

Whether the indictment will help or hinder Trump politically is yet to be seen, though early fundraising numbers suggest the charges have mobilized his base. But experts say legally, the indictment changes little for how the former president can proceed in his bid for the nation’s highest office.

Can Trump still run for president if indicted? Convicted?

“Absolutely,” said Jessica Levinson, founding director of Loyola Law School’s Public Service Institute.

The Constitution lays out the exclusive qualifications to run for the presidency, she said.

There are three requirements:

Natural-born citizen.
At least 35 years old.
Resident of the U.S. for at least 14 years.

“That could be because the founders just didn’t envision that we would have people who are facing indictment and potentially conviction running for the highest office in the land,” she said.

In fact, the former president has said he does not plan to drop out of the 2024 race despite his legal problems.

“I won’t even think about leaving,” Trump told reporters before a speech at the Conservative Political Action Conference in March.

“Probably, it’ll enhance my numbers.”

Why was Trump indicted?

The charges against Trump have not been made public. But the New York grand jury was investigating the former president for a $130,000 payment he made just before the 2016 election to silence adult film star Stormy Daniels about an earlier affair.

Trump has denied the affair and any wrongdoing, calling the investigation a politically motivated “witch hunt” and urging his supporters to protest his treatment. Trump lawyer Joseph Tacopina called the indictment a “political prosecution” and said Trump’s team would fight it in court.

How does a grand jury work?

Grand juries decide whether a prosecutor’s evidence provides probable cause to issue an indictment, according to Cornell Law School’s Legal Information Institute.

Usually made up of 16 to 23 people, grand juries meet in private as an investigative body independent of a prosecuting attorney or judge. A district attorney shows the grand jury evidence and asks jurors to consider certain charges, David Weinstein, a former federal and state prosecutor, told USA TODAY.

Then the jury votes in secret on whether enough evidence exists to charge someone with a crime. If the majority of the jury believes a person committed a crime, it returns with an indictment. If it does not, the person is not required to plead to a criminal charge and there is no trial.

To be a grand juror in New York, where Trump was indicted, a person must be a U.S. citizen, at least 18 years old, a resident of the county to which they’re summoned to serve and able to understand and communicate in English. A person can’t have a felony conviction.

The exact charges Trump faces are still unknown. But the grand jury’s investigation gives some insight into the law or laws the former president may have broken.

Public information from witnesses who have been debriefed by prosecutors and provided testimony to the grand jury indicate that the investigation’s main focus has not strayed far from the payment Trump made to Daniels ahead of his 2016 campaign.

The hush money payment could be used to build a case for falsifying business records and violating campaign finance law.

“The crime here appears to be the falsification of business records to conceal the hush money payments by falsely describing them as legal fees,” said Barbara McQuade, a former U.S. attorney and now law professor at the University of Michigan. “The crime becomes a felony if it covers up another crime.”

Is hush money legal?

A hush money payment itself is not illegal, according to Levinson and McQuade.

“In this case, it appears that Stormy Daniels sold the rights to her story about an alleged affair with Trump to the National Enquirer, giving it exclusive rights to print it,” McQuade said. “The National Enquirer chose to never print the story. As long as Daniels got paid, there is no crime in that contractual arrangement.”

Former President Donald Trump has been indicted as part of the Manhattan District Attorney’s Office’s years-long investigation, possibly for hush money payments.

Manhattan District Attorney Alvin Bragg has been investigating Trump for hush money payments made leading up to the 2016 presidential election.

Hush money payments made to both McDougal and Daniels were revealed and reported by Fox News in 2018. Those payments had been investigated by the U.S. Attorney’s Office in the Southern District of New York and by the Federal Election Commission.

Federal prosecutors in the Southern District of New York opted out of charging Trump related to the Stormy Daniels payment in 2019, even as Trump’s former attorney Michael Cohen implicated him as part of his plea deal. The Federal Election Commission also tossed its investigation into the matter in 2021.

“This evening we contacted Mr. Trump’s attorney to coordinate his surrender to the Manhattan D.A.’s Office for arraignment on a Supreme Court indictment, which remains under seal,” a spokesperson for the Manhattan District Attorney’s Office said in a statement Thursday. “Guidance will be provided when the arraignment date is selected.”

Trump reacted to his indictment, slamming Bragg for his “obsession” with trying to “get Trump,” while warning the move to charge a former president of the United States will “backfire.”

Bragg, when he took over as district attorney in January 2022, stopped pursuing charges against Trump and suspended the investigation “indefinitely,” according to one of the top prosecutors who resigned from the office in protest.

Prosecutors Mark Pomerantz and Carey Dunne, who had been leading the investigation under former DA Cyrus Vance, submitted their resignations after Bragg began raising doubts about pursuing a case against Trump.

Trump, earlier this month, cited reports, which were based on what he called “illegal leaks,” that suggested he could be arrested on Tuesday, March 21. Trump posted about those reports on his TRUTH Social, leading the House Judiciary Committee to intervene, demanding Bragg testify before the panel.

Republican lawmakers and allies of Trump blasted the investigation as a political prosecution and a “weaponization” of the office of the district attorney.

Bragg, last week, claimed that Trump “created a false expectation” that his arrest was imminent, citing the former president’s TRUTH Social post, and slammed the committee for making an “unprecedented inquiry into a pending local prosecution.”

“The Letter only came after Donald Trump created a false expectation that he would be arrested the next day and his lawyers reportedly urged you to intervene,” Bragg wrote in a letter to the committee. “Neither fact is a legitimate basis for congressional inquiry.”

Last week, Robert Costello, a former legal advisor to Michael Cohen, testified before the grand jury last Monday that Cohen was a “serial liar,” and testified that Trump did not know about the payments made by Cohen to Daniels.

Bragg then canceled grand jury proceedings related to the Trump probe on Wednesday and Thursday.

Sources, at the time, told Fox News Digital that there was “major dissension” within the district attorney’s office. One source claimed the district attorney is having trouble convincing the grand jury on potential charges due to the “weakness” of the case.

Cohen, in 2018, was sentenced to three years in prison after pleading guilty to federal charges, including tax evasion, lying to Congress, and campaign finance violations. Cohen pleaded guilty to arranging payments to Daniels and McDougal to prevent them from going public with alleged affairs with Trump, which Trump has repeatedly denied.

Cohen has said Trump directed the payments—which the former president has denied for years.

Cohen paid Daniels $130,000 through his own company and was later reimbursed by Trump’s company, which logged the payments as “legal expenses.” McDougal received $150,000 through the publisher of the supermarket tabloid the National Enquirer.

The Trump Organization “grossed up” Cohen’s reimbursement for Daniels’ payment for “tax purposes,” according to federal prosecutors who filed the 2018 criminal charges against Cohen for the payments.

Trump has repeatedly denied wrongdoing with regard to the payments made to Daniels and McDougal, and has repeatedly said the payments were “not a campaign violation,” but rather a “simple private transaction.”

The payments to Daniels were first revealed in January 2018 in a Wall Street Journal report that said Cohen and Daniels’ lawyer negotiated a nondisclosure agreement to prevent her from publicly discussing the supposed sexual encounter with Trump.

At the time, though, Cohen, Trump, and even Stormy Daniels denied the arrangement.

In January 2018, Cohen said the alleged encounter between Daniels and Trump was a rumor that had circulated “since 2011.”

And in a letter dated Jan. 10, 2018, obtained and reviewed by Fox News, Daniels also denied the allegations.

“I recently became aware that certain news outlets are alleging that I had a sexual and/or romantic affair with Donald Trump many, many, many years ago. I am stating with complete clarity that this is absolutely false,” Daniels wrote. “My involvement with Donald Trump was limited to a few public appearances and nothing more.”

Daniels wrote in the letter that when she met Trump, he was “gracious, professional and a complete gentleman to me and EVERYONE in my presence.”

“Rumors that I have received hush money from Donald Trump are completely false,” the letter read. “If indeed I did have a relationship with Donald Trump, trust me, you wouldn’t be reading about it in the news, you would be reading about it in my book. But the fact of the matter is, these stories are not true.”

But in March 2018, Daniels changed her story. During an interview with CBS News’ “60 Minutes,” Daniels claimed she had a one-time, unprotected sexual encounter with Trump.

Meanwhile, as for the McDougal payment, David Pecker, the former CEO of American Media Inc., testified before the Manhattan grand jury Monday. It was at least the second time he has appeared before the panel as part of Bragg’s Trump investigation.

American Media Inc. is the parent company and publisher of National Enquirer. The company allegedly bought McDougal’s story from her, in which she claimed a past affair with then-candidate Donald Trump, for $150,000 in September 2016—weeks before the 2016 presidential election.

The charges against the former president come after the Federal Election Commission, in 2021, dropped its case on the same issue— examining whether Trump violated election law with the $130,000 payment made to Stormy Daniels, after it “failed by a vote of 2-2 to…find reason to believe that Donald J. Trump knowingly and willfully violated” federal election law.”

The investigation into Trump was opened in 2019 by then-Manhattan District Attorney Cyrus Vance. The probe was focused on possible bank, insurance and tax fraud. The case initially involved financial dealings of Trump’s Manhattan properties, including his flagship Fifth Avenue building, Trump Tower, and the valuation of his 213-acre estate Seven Springs in Westchester.

The investigation, last year, led to tax fraud charges against The Trump Organization, and its finance chief Allen Weisselberg.

Meanwhile, the charges against Trump come amid a separate, special counsel investigation into his alleged improper retention of classified records from his presidency at his Mar-a-Lago home.

Last August, the FBI, in an unprecedented move, raided Trump’s private residence at Mar-a-Lago in connection with an investigation into classified records the former president allegedly took with him from the White House.

Attorney General Merrick Garland later appointed Jack Smith as special counsel to take over that investigation, and the Justice Department’s investigation into the Capitol riot on Jan. 6, 2021 — specifically whether Trump or other officials and entities interfered with the peaceful transfer of power following the 2020 presidential election, including the certification of the Electoral College vote on Jan. 6, 2021.

The charges against Trump also come while New York Attorney General Letitia James continues her years-long civil investigation into the Trump Organization to find out whether Trump and his company improperly inflated the value of assets on financial statements in order to obtain loans and tax benefits.

Bragg’s indictment of Trump is a classic abuse of power

Much ink has already been spilt on the egregious heap of due process violations Manhattan District Attorney Alvin Bragg has piled up in his prosecution of former President Donald Trump.

There is the fact that he is better understood as an elected progressive Democrat who won office in the Big Blue Apple by vowing to leverage his power against the Democrats’ arch nemesis, not as a good faith law-enforcement official who takes seriously the duty to ensure equal protection of the laws to all Americans.

There is his invocation of trivial business-records misdemeanors against a partisan foe at the same time he is refusing to enforce felony offenses against hardened criminals who prey on New Yorkers.

There is his apparent attempt to transmogrify misdemeanors into felonies by alleging a federal campaign finance violation that he has no jurisdiction to enforce, and that the federal prosecutors and regulators who do have jurisdiction declined to prosecute due to lack of evidence.

But let’s hone in on newly emerging prosecutorial misconduct.

If reporting is accurate — and note that the reporting is based on information from Trump lawyers after Bragg’s office advised them of the indictment — then the district attorney has charged a whopping 34 counts against Trump. Thirty-four counts … in a case, again, that federal prosecutors decided wasn’t worth charging at all.

This is a classic abuse of power. Unscrupulous prosecutors will sometimes camouflage with quantity their case’s lack of quality.

When serious crimes have been committed, prosecutors do not need to run up the score with a high number of counts. A single charge, or a handful of them, provides the court with more than enough years of sentencing exposure. Once convicted, a serious criminal in that kind of case will be incarcerated for a very long time — even for life.

By contrast, if prosecutors do not have evidence of a serious crime, by loading up an indictment with dozens of charges, they can try to signal to the eventual trial jury that the defendant must be guilty of something. They hope the jurors will assume that, even if the evidence doesn’t seem strong, the government wouldn’t have alleged so many crimes unless the defendant was a truly diabolical criminal.

This is a significant enough due process abuse that, in federal law, the Justice Department has guidance directing prosecutors not to engage in it:

In order to promote the fair administration of justice, as well as the perception of justice, all United States Attorneys should charge in indictments and informations as few separate counts as are reasonably necessary to prosecute fully and successfully and to provide for a fair sentence on conviction.To the extent reasonable, indictments and informations should be limited to fifteen counts or less, so long as such a limitation does not jeopardize successful prosecution or preclude a sentence appropriate to the nature and extent of the offenses involved.

If Bragg is indicting 34 counts over this nonsense, it’s because he doesn’t have one count he would be indicting if he were doing his job right.

Former Attorney General Bill Barr said Friday that he suspects Democrats are pushing the indictment of former President Trump to help him win the 2024 Republican nomination in the hopes that Trump’s legal baggage will sink him in the general election.

“I think the impetus is really to help Trump get the nomination, focus the attention on him for two years, have this thing swirling around, plus whatever else comes which I think will be damaging to whoever gets the nomination,” Barr, one of Trump’s attorneys general, said Friday at the National Review Institute Ideas Summit.

Barr generally dismissed the Trump indictment as a politically motivated event.

NEW YORK PROSECUTORS SIGNAL TRUMP MAY FACE CRIMINAL CHARGES FROM STORMY DANIELS SCANDAL

A court source told Fox News Digital that Manhattan District Attorney Alvin Bragg’s office will meet with law enforcement to “discuss logistics for some time next week, which would mean that they are anticipating an indictment next week.”

The potential indictment stems from the yearslong investigation surrounding Trump’s alleged hush money scandal involving porn star Stormy Daniels. Toward the end of the 2016 presidential campaign, Trump’s then-lawyer Michael Cohen sent $130,000 to Daniels to prevent her from disclosing her 2006 affair with Trump. Trump reimbursed Cohen through installments.

In a lengthy statement to Fox News Digital, Trump spokesperson Steven Cheung blasted the investigation as a “witch hunt” and accused Bragg of being in the pocket of President Biden and “radical Democrats.”

“President Donald J. Trump is completely innocent, he did nothing wrong, and even the biggest, most Radical Left Democrats are making that clear,” Cheung said.

Reached for comment Friday, the Manhattan District Attorney’s office would neither “confirm or comment” on the impending indictment.

Former President Donald Trump announced his third presidential bid one week after the midterm elections

PALM BEACH, Fla. – Former President Donald Trump announced that he is running for the 2024 Republican nomination for president, seeking to stage a dramatic return to the White House after having lost his bid for re-election to Joe Biden in 2020.

Trump, a Republican and the leader of the “Make America Great Again” movement, announced his third presidential bid on Tuesday during a speech at his Mar-a-Lago, Florida, home after having teased a bid since leaving office in 2021.

“In order to make America great and glorious again. I am tonight announcing my candidacy for president of the United States,” Trump said Tuesday evening to a crowd of supporters.

“But just as I promised in 2016, I am your voice. I am your voice. The Washington establishment wants to silence us, but we will not let them do that. What we have built together over the past six years is the greatest movement in history because it is not about politics. It’s about our love for this great country, America, and we’re not going to let it fail,” said Trump.”I am running because I believe the world has not yet seen the true glory of what this nation can be. We have not reached that pinnacle, believe it or not,” he continued, blaming President Biden for the current state of the nation. “In fact, we can go very far. We’re going to have to go far first. We have to get out of this ditch. And once we’re out, you’ll see things that nobody imagined for any country. It’s called the United States of America. And it’s an incredible place.”

Trump first won the presidency in 2016 against former Secretary of State Hillary Clinton. If he is elected again, he would become only the second president to retake the White House after having been ousted, a feat achieved by Grover Cleveland in 1892 after he had lost the presidency to Benjamin Harrison in 1888. A victory would make Trump the 45th and the 47th president.

Since his loss, Trump has challenged the legitimacy of the 2020 election results, repeatedly claiming the race was “rigged,” due to the COVID pandemic-era process of mail-in ballots. Trump falsely claimed the election was stolen, and his legal team filed a slew of lawsuits in battleground states across the nation.

Trump’s announcement comes one week after the 2022 midterm elections in which Republicans did not obtain an anticipated “red wave” of victories. Democrats kept control of the Senate and if Republicans are able to capture a majority in the House, it is expected to be slight. The former president was heavily involved in the midterms, throwing his support behind Republican candidates across the nation. During the primaries, the majority of Trump-endorsed candidates were victorious, becoming the GOP nominee in their races.

The economy, which has been a top issue for voters during the 2022 midterm election cycle amid record-high inflation, was strong under Trump’s presidency—with an increase in middle-class family income, the lowest unemployment rate in half a century and unprecedented job growth.

The stock market hit record highs, with the Dow closing above 20,000 for the first time in 2017 and topping 30,000 in 2020, and the S&P 500 and NASDAQ also hitting record highs.

Trump also worked to cut red tape and reduce regulations facing American businesses and workers, working to put in place policies to bring back supply chains from overseas, in line with his “Make America Great Again” and “America First” messaging.

As for trade relations, Trump immediately withdrew from the Trans-Pacific Partnership and ended the North American Free Trade Agreement (NAFTA) in January 2017, replacing it with the existing United States-Mexico-Canada Agreement (USMCA), which included new protections for American manufacturers and workers.

Trump also signed an executive order making it government policy to “Buy American and Hire American,” and took action to stop outsourcing of jobs overseas.

Another issue for Americans during the midterm election cycle has been energy and record-high gas prices.
