Under federal law, perjury is committed when a person “knowingly” attests to or subscribes to statements he or she does not believe are true. Perjured testimony is not protected by the First Amendment, because it undermines the ability of courts to obtain truthful testimony and to effectively administer justice. Alger Hiss, accompanied by his wife Priscilla, leaves Federal Courthouse, New York, June 23, 1949 at the conclusion of his testimony in his perjury trial. Hiss appeared on the stand for the first time in the trial and denied that he ever had been a member of the communist party, or a communist sympathizer. Prior restraint is a form of censorship that allows the government to review the content of printed materials and prevent their publication. Most scholars believe that the First Amendment’s guarantee of freedom of the press includes the restriction of prior restraints. In numerous cases, the Supreme Court has indicated that the Constitution establishes a strong presumption against such prior restraints. In this June 30, 1971 photo, workers in the New York Times composing room in New York look at a proof sheet of a page containing the secret Pentagon report on Vietnam. In a 6-3 decision, the Supreme Court ruled in New York Times Co. v. United States (1971) that despite the sensitive nature of the information, the newspapers could still publish it under the no prior restraint doctrine.
